PICKERN v. HOLIDAY QUALITY FOODS, INC., 00-17203
In a suit for injunctive relief under ADA Title III, where a disabled plaintiff has actual knowledge of illegal barriers to access by a public accommodation, plaintiff need not make the "futile gesture" of attempting to gain access in order to show actual injury during the limitations period.
