United States Ninth Circuit

VASQUEZ v. N. COUNTY TRANSIT DIST., 01-55326, 01-55415

The "firefighter's rule", barring firefighters and police officers from suing those whose negligence caused a dangerous condition that resulted in injury, will not automatically bar a police officer's claim for injury from a railroad crossing-gate, because the "independent cause" exception may apply.
