ARAGON v. REPUBLIC SILVER STATE DISPOSAL, INC., 01-15951

Though summary judgment for the employer in an employment discrimination case was improper at the "prima facie" stage, judgment is affirmed where a laid-off worker failed to show that legitimate and non-discriminatory reasons for termination (seasonal downturn and poor performance) were a pretext for racial discrimination.
