Denial of attorney's fees was proper under the Hyde Amendment, 18 U.S.C. section 3006A, where appellant, an attorney indicted for mail fraud, whose indictment was dismissed in accordance with a completed diversion agreement, was not a "prevailing party" under that statute, but was more akin to a convicted defendant.
