United States Ninth Circuit

US v. ROSALES-RODRIGUEZ, 00-50145

Where judge informed a jury that if they were still deliberating at the end of the day, an alternate juror would be called and deliberations would begin anew, such error was harmless; denial of instruction on voluntary intoxication was proper where jury's verdict showed that the issue was irrelevant.
