United States Ninth Circuit
LEATHERMAN TOOL GROUP, INC. v. COOPER INDUS., INC., 98-35147, 99-35415
On remand from the US Sup. Ct., which instructed that appellate courts must review independently the constitutionality of punitive damage awards, Circuit Court reduced its initial punitive award, in case where defendant passed off drawings and photographs of plaintiff's product as its own when it first attempted to enter the market, of $4.5M to $500,000, the maximum award it deemed to be consistent with due process.
