LOPEZ v. WASHINGTON MUT. BANK, INC., 01-15303

Bank's practice of using directly deposited Social Security and SSI benefits to offset overdrafts runs afoul of 42 U.S.C. sections 47(a) and 1383(d)(a); plaintiff's state law claims for violation of Cal. Bus. & Prof. Code section 17200 and conversion are not preempted by Office of Thrift Supervision regulations because they do not impose any requirements on deposit-related activities of a federal savings institution.
