GRAY v. KLAUSER, 00-35732

The trial court's asymmetrical application of Evidence Rule 803(24), allowing the government but not the defendant to admit hearsay evidence of similar import and character, violated the constitutional prohibition against arbitrary application of evidentiary standards to defendants.
