PEREZ-ARELLANO v. SMITH, 00-35553

In an appeal of a claim to recover attorney fees pursuant to EAJA, 28 U.S.C. section 2412(d), denial of fees was proper because plaintiff was not a "prevailing party," in that he did not gain a change in the legal relationship with the INS by judgement or consent decree.
