Section 303 of the Food, Drug and Cosmetic Act, 21 U.S.C. Section 333(a)2, which imposes liability for misbranding with the intent to defraud or mislead, requires, as an element of the offense, proof of materiality under either a theory of intent to defraud or intent to mislead.
