HAMILTON v. STATE FARM FIRE & CAS. CO., 00-55530

An insured/debtor's knowing failure to list bad faith claim against insurer as asset of bankruptcy estate will judicially estop a latter suit for bad faith where he initially obtained a discharge from the misrepresentation even if the discharge was later vacated.
