BOULDER FRUIT EXPRESS & HEGER ORGANIC FARM SALES v. TRANSP. FACTORING, INC.,, 99-56770
The Perishable Agricultural Commodities Act, 7 USC 499a-499t, does not prohibit trustees from attempting to turn receivables into cash by factoring, but the arrangement must be commercially reasonable and not breach or otherwise dissipate the trust.
