A majority owner who contractually cedes all managerial control to another loses the ability to "develop and direct" the enterprise, as required by 8 USC 1101(a)(15)(E)(ii) and 22 CFR 41.51(p), for purposes of qualifying for an E-2 treaty investor visa.
