United States Ninth Circuit

Under the transitional rules of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, an appellate court has jurisdiction to hear an appeal from a suspension of deportation claim for a drug addicted alien because drug addiction is not a criminal offense.
