US v. DeCoteau, 10-2122
Defendant's conviction and sentence for aggravated sexual abuse of a child and abusive sexual contact are affirmed where: 1) defendant did not commit error or abuse its discretion in finding defendant competent to stand trial; 2) a reasonable jury could find from all of this that the government had submitted sufficient evidence of digital penetration; and 3) the district court did not err by holding that it lacked authority to sentence him below the statutory mandatory minimum of 30 years.
