In a 42 U.S.C. section 1983 suit claiming that Missouri revenue agents wrongfully seized a large quantity of cigarettes from plaintiff's retail stores, the denial of attorney's fees to plaintiff is affirmed where, by plaintiff's own admission, a related state-court decision did not resolve the issue plaintiff originally sought to have adjudicated in federal court: whether the defendants’ conduct violated the Constitution.
