United States Eighth Circuit

US v. Clay, 09-3134

Defendant's convictions for conspiracy to commit wire fraud and money laundering are affirmed where: 1) defendant did not need to be directly involved in the transmission of loan proceeds from the lenders to the title companies at issue; 2) the testimony at trial supported the jury's verdict that defendant engaged in a conspiracy to defraud the purchasers and that the purchasers were harmed by the conspiracy; and 3) defendant failed to establish that the district court abused its discretion in instructing the jury on the reasonable doubt standard as it pertained to whether defendant acted knowingly.
