US v. Asalati, 09-2894
The district court's order revoking defendant's supervised release on the ground that he violated the conditions of his release by, among other things, committing an assault, is affirmed where: 1) defendant's arguments were insufficient to overcome the high barrier to reversal of a district court's credibility finding; and 2) any difference in treatment was due to defendant's immigration status and his continued inability to operate within the confines of the law.
