Graves v. Ault, 09-2850

In a murder prosecution, a denial of petitioner's habeas petition is affirmed where: 1) petitioner did not give the state courts an opportunity to review his claim that the Iowa Court of Appeals' decision was based upon an unreasonable determination of the facts in violation of 28 U.S.C. section 2254(d)(2); and 2) the cumulative effect of any prosecutorial misconduct was outweighed by the strength of the properly admitted evidence of petitioner' guilt.
