United States Eighth Circuit
Sherbrroke v. City of Pelican Rapids, 08-2645
In a civil action brought against the City of Pelican Rapids, the city's police chief and two police officers, district court's final judgment in favor of the defendants on all claims is affirmed where: 1) the district court properly dismissed defendant's claims for false arrest and malicious prosecution as his arrest was supported by probable cause; 2) the conspiracy claim was correctly dismissed as defendant's sole contention is that the police officers conspired to commit the torts of false arrest and malicious prosecution.
