US v. Harris, 09-1155

Sentence for drug crimes is affirmed where: 1) defendant did not have a constitutional right to appointment of counsel for his 18 U.S.C. sec. 3582(c)(2) sentence modification proceeding; 2) defendant did not have a right to appointment of counsel under the Criminal Justice Act for the proceedings; and 3) the district court did not err in denying defendant's request for a hearing.
