United States Eighth Circuit

US v. Hrasky, 07-3141

Conviction for unlawful possession of a firearm as a previously convicted felon is vacated and remanded where the government concedes that under the rule announced in the Supreme Court's decision in Arizona v. Gant, the search of defendant's vehicle violated the Fourth Amendment and thus the handguns seized from the vehicle must be suppressed.
