United States Eighth Circuit

US v. James, 08-2356

Conviction and sentence for drug crimes is affirmed where: 1) district court did not abuse its discretion in admitting evidence of defendant's prior drug conviction, and evidence that defendant brandished a firearm and threatened the arresting officers; and 2) district court did not err in imposing a two-level enhancement for obstruction of justice based on the determination that defendant perjured himself at trial, and the sentence was not unreasonable and did not violate the Eighth Amendment.
