Pate-Fires v. Astrue, 07-3561

In a dispute involving disability insurance benefits, district court order affirming the denial of plaintiff's application for disability insurance benefits and supplemental security income is reversed where: 1) the ALJ's finding that plaintiff retained the residual functional capacity to perform her past work was not supported by substantial evidence; 2) the ALJ's finding that plaintiff's medical noncompliance was not justifiable and precludes a finding of disability is not supported by substantial evidence; and 3) the medical evidence showed claimant suffers from a severe mental impairment and cannot be expected to engage in gainful employment.
