Vonage Holdings Corp. v. Nebraska Pub. Serv. Comm'n, 08-1764

District court's grant of injunction is affirmed where the court did not abuse its discretion in enjoining enforcement of the Nebraska Public Service Commission order requiring nomadic interconnected VoIP service providers to collect a universal service fund surcharge for intrastate usage as federal law preempts all state regulation of nomadic interconnected VoIP service providers and the FCC is the sole regulatory control.
