Mueller v. Astrue, 08-1756

In an action involving social security benefits, district court's order affirming the Social Security Administration's denial of plaintiff's application for disabled widow's benefits is reversed and remanded where: 1) the ALJ's step-one determination that plainitff was not engaged in substantial gainful activity is supported by substantial evidence, despite the ALJ's failure to confine his step-one analysis to the correct time period; and 2) the ALJ's erred in its step-four analysis as substantial evidence does not support the determination that plaintiff had past relevant work as a substitute teacher.
