Fallo v. High-Tech Inst., 08-2437
In a dispute between students and a for-profit vocational school, district court's judgement in favor of plaintiff's is reversed and remanded where: 1) the court erred in determining that it had the authority to decide the question of arbitrability of the students' tort claims; 2) the court erred in denying defendant's motion to compel arbitration as the parties' incorporation of AAA Rules is clear evidence that they intended to allow an arbitrator to decide the question of arbitrability.
