US v. Fuller, 08-2262

Conviction and sentence for conspiracy to distribute cocaine is affirmed where: 1) the evidence was sufficient to support a guilty verdict; 2) district court did not err in denying defendant's motion for a new trial based on newly-discovered evidence as the evidence was not material; 3) any mistake in admitting witness statement that plaintiff claims was double hearsay would at worst have constituted only harmless error; and 4) plaintiff was not unfairly prejudiced by prosecutor's conduct.
