ProGrowth Bank, Inc. v. Wells Fargo Bank, N.A., 07-3948

In a declaratory judgement action seeking to determine the priority of perfected security interests, district court's grant of plaintiff's motion for summary judgment is reversed. The defendants' financing statements that listed all of debtor's assets and all proceeds in certain annuity contracts but erroneously listed the contract number and entity issuing were not seriously misleading and thus sufficient to perfect the defendants' security interests.
