Willcox v. Liberty Life Assurance Co. of Boston, 08-1311
In an ERISA suit alleging that defendant wrongfully denied plaintiff's claim for long term partial disability benefits, summary judgment for plaintiff is affirmed where defendant abused its discretion by relying on the opinions of two reviewing physicians which mischaracterized the medical evidence and ignored key findings in support of plaintiff's claim.
