United States Eighth Circuit

US v. Lee, 07-3738

Sentence for possession of a firearm by a felon is affirmed where: 1) the district court's explanation for the chosen sentence was not plainly inadequate; 2) Eighth Circuit precedent did not cause the district court to apply an impermissible presumption in favor of a sentence within the advisory range; and 3) the sentence was not substantively unreasonable.
