Elbert v. True Value Co., 08-1222
In an action for retaliatory discharge against plaintiff's former employer under 49 U.S.C. section 31105(a) of the Surface Transportation Assistance Act (STAA), dismissal of the action is affirmed where the district court correctly found that the retroactive application of a jurisdiction-conferring amendment to the STAA would affect defendant's substantive rights.
