Jones v. Mountaire Corp. Long Term Disability Plan, 07-3118
In an ERISA action arising from a denial of plaintiff's claim for long term disability benefits under an employer-provided plan, a ruling awarding plaintiff benefits is remanded where the district court erred by failing to give the parties an opportunity to brief the issues of the merits of and the differences between two job databases, and the reasons that the plan administrator used one instead of the other in evaluating the claim.
