After remand of a licensing dispute alleging violation of the Federal Telecommunications Act, summary judgment in favor of defendant and denial of plaintiff's motion to reopen discovery are affirmed where plaintiff did not show actual or effective prohibition from providing telecommunications services and previously had the opportunity to address this element in discovery.
