United States Eighth Circuit

Hinz v. Neuroscience, Inc., 07-2694, 07-2699

In a diversity breach of contract suit wherein a jury returned a verdict for plaintiffs, grant of judgment as a matter of law for defendants on the issue of damages, and rulings denying other requested relief for plaintiff are affirmed where: 1) the district court had jurisdiction to enter an amended judgment reversing the damage award; 2) there was insufficient evidence for the damage award; 3) the district court did not err in instructing the jury on the measure of damages; and 4) it properly denied plaintiffs a permanent injunction, pre- and post-judgment interest, and attorney's fees and costs.
