United States Eighth Circuit
Thornton Drilling Co. v. Nat'l Union Fire Ins. Co. of Pittsburgh, 07-2950, 07-3079
In a dispute over indemnity for a wrongful death action arising when an individual was killed by an explosion or blowout while working on an oil drilling rig leased to plaintiff by defendant, a judgment finding that plaintiff must indemnify defendant and that the obligation was covered by its umbrella liability insurer is affirmed where conflicting indemnity provisions in certain subsequent agreements fully satisfied an "expressly agreed otherwise" provision in the parties' Contractor's Master Agreement.
