Habhab v. Hon, 07-3386
In a towing and car repair operator's civil rights suit against several Iowa state patrol troopers claiming violations of equal protection, as well as violations of procedural and substantive due process, summary judgment for defendants is affirmed where: 1) plaintiff failed to demonstrate state troopers treated him less favorably than similarly-situated owners of other towing companies based upon his ethnicity; 2) for purposes of a procedural due process claim, the district court did not err in determining plaintiff did not have a property interest and it properly found he had not been deprived of any liberty interest; and 3) substantive due process claims also failed.
