United States Eighth Circuit

US v. Mooney, 07-1701

A sentence for being a felon in possession of a firearm is affirmed where the sentence was substantively reasonable and the record as a whole did not support claims that the district court erred by: 1) treating the Sentencing Guidelines as mandatory rather than advisory; and 2) by failing to consider the sentencing factors contained in 18 U.S.C. section 3553(a).
