West v. Local 710, Int'l Brotherhood of Teamsters Pension Plan, 07-2659/2674
In an action arising after ERISA plan administrators determined that employee-plaintiff was not entitled to full pension benefits, summary judgment for plan administrators is affirmed but denial of plan administrator's motion seeking attorney's fees is reversed and remanded where: 1) administrator's interpretation of pension documents was not unreasonable or arbitrary; 2) administrator did not abuse its discretion in denying employee's application for Special Regular Pension; but 3) the district court erred in denying plan administrator any attorney's fees before it had filed a motion requesting fees and documenting its request.
