US v. Brown, 06-3772

Denial of a motion for post-conviction relief from a conviction and sentence for kidnaping and aggravated sexual abuse of a ten year-old child is affirmed where: 1) performance by defendant's appellate counsel, in failing to raise a Confrontation Clause argument concerning the district court's decision to have a child victim testify via a closed-circuit television, was not deficient; and 2) defendant was not prejudiced by a failure to raise the Confrontation Clause issue on direct appeal.
