Bath Junkie Branson, L.L.C. v. Bath Junkie, Inc., 07-3042/08-1757

An order denying appellants-franchisors' motion for an evidentiary hearing, raised after the district court announced its intentionto enforce a settlement agreement between the parties, is affirmed where: 1) franchisors failed to make a timely request for an evidentiary hearing; 2) their pleadings did not suggest that additional evidence would be useful; and 3) there was no substantial factual dispute over the terms of the settlement agreement.
