Hervey v. County of Koochiching, 06-3891

In a Title VII action brought by a plaintiff-employee alleging claims of gender discrimination and retaliation based on her participation in protected activity, judgment for employer is affirmed and the case is remanded with directions to modify the final judgment to dismiss certain state law claims without prejudice where: 1) plaintiff failed to produce evidence linking adverse employment actions against her to gender discrimination and evidence showing employer's retaliatory motives based on her engagement in protected activities; and 2) plaintiff's state law claims brought under supplemental jurisdiction may be considered by Minnesota courts.
