United States Eighth Circuit

NLRB v. Bolivar-Tees, Inc, 07-2334

Petition for enforcement of a NLRB order is granted where the board did not err in piercing the corporate veil in light of substantial evidence to support a finding that: 1) the corporation's shareholder and operating officer failed to maintain corporate formalities by keeping corporate assets distinct; and 2) adherence to the corporate fiction would sanction a fraud, promote injustice or lead to an evasion of legal obligations.
