Buboltz v. Residential Advantages, Inc., 07-2065

In an action instituted by a legally blind former employee for employer's alleged violations of ADA, summary judgment for employer is affirmed where: 1) employee failed to show that she suffered an adverse employment action; 2) employee's constructive discharge claim failed, as she failed to produce any evidence that her employer acted deliberately to render her working conditions intolerable; and 3) employee did not request an accommodation, and thus employer's duty to accommodate never arose.
