US v. Garcia, 07-2615

Conviction and sentence for conspiracy to distribute methamphetamine and aiding and abetting the distribution of methamphetamine is affirmed over defendant's claims that: 1) there was insufficient evidence to support the jury verdict because the government did not prove he had actual knowledge of the underlying offenses; and 2) the sentence constituted a cruel and unusual punishment, in sentencing him to a mandatory minimum term of imprisonment based on factors over which he was without control and knowledge.
