US v. Pepper, 06-2453

On remand for reconsideration in light of Gall v. US, 522 U.S. ___ (2007), a sentence for drug-related offenses is again reversed and remanded for resentencing by a different judge where the district court procedurally erred by failing to explain adequately defendant's sentence and by relying predominantly on improper factors to determine a sentence variance.
