King v. Hardesty, 06-4163
In an action brought by a former employee of defendant-school district alleging racial discrimination and retaliation under 42 U.S.C. sections 1981 and 1983, summary judgment for defendants is affirmed in part, but reversed in part and remanded where: 1) the district court erred in finding that plaintiff had not provided any direct evidence of discrimination and by not analyzing her termination and non-assignment of homebound instruction claims under the proper approach; and 2) the district court also erred in certain summary judgment rulings made under the McDonnell Douglas test for various claims.
