Hohn v. Spurgeon, 07-1087
In an action alleging that defendant-doctor tortiously interfered with plaintiff's expected business relationship with another party, summary judgment for defendant is reversed and remanded where: 1) the district court erred in determining that plaintiff failed to present any evidence that created a genuine issue of whether defendant's actions were within the scope of his employment; and 2) a motion to amend the complaint should be reconsidered.
