Guardian Fiberglass, Inc. v. Whit Davis Lumber Co., 06-3896

In a suit brought against defendant-lumber company to enforce a restrictive covenant not to compete, summary judgment for defendant is affirmed where plaintiff could not show that the covenant was necessary to protect its goodwill or to prevent defendant from engaging in unfair competition, and thus it was unable to demonstrate a legitimate business interest justifying the restrictive covenant.
