United States Eighth Circuit

US v. Stewart, 07-1077

A sentence for drug-related offenses is vacated and remanded where the circuit court could not determine whether the district court reasonably exercised its discretion in sentencing defendant because it did not indicate: 1) how defendant's assistance was evaluated; and 2) what extraordinary circumstances could exist justifying the extraordinary reduction of eleven levels in his sentence.
